NIV Process Frequently Asked Questions

Two of the most common questions that the consular section receives regarding non-immigrant visas are 1) how important is the application form and 2) how do I qualify for a non-immigrant visa? 

The application form is the most important source of information for the consular officer.  In each case, a consul closely reviews the information on the form.  It is therefore important that the form be filled out completely and correctly.  Any questions that are left unanswered may cause your case to be delayed or denied.  There are specific questions regarding prior applications, immigrant visa applications, your family and your history that must be answered correctly.  It is better to answer a question honestly than to leave a question blank or put incorrect information.  Remember, the application form is a legal document that must be signed by the applicant.  Your case cannot be processed without your signature.

Each time you apply for a non-immigrant visa, the officer will consider your current application.  Prior refusals do not necessarily make you ineligible for a visa.  In each case, the officer will thoroughly review your application and ask a few directed questions to supplement the information you provided on the form.  A consul may, on occasion, ask for additional documents to supplement the interview.  After the consul has all of the information, he or she will make a decision.

The key to qualifying for a non-immigrant visa is honesty.  If a consul believes that you are not being honest in the interview, she will deny your application.  Likewise, when a consul is initially unsure about a case, honesty goes a long way in convincing her to approve your case.  Having a complete and correct application and an honest interview are the key requirements for approval of your visa.
